These Terms of Use apply to your use of the Countryman Solar website (the “website”). By accessing or using the website you agree to these Terms. If you do not agree, please do not use the website.
In these Terms, “Countryman Solar”, “we”, “us” and “our” means the business trading as Countryman Solar, Suite 329/98-100 Elizabeth Street, Melbourne VIC 3000.
1. Information on this website
The content on this website – including product information, system sizes, savings, payback periods, performance figures and rebate information – is general information only. It does not take into account your property, roof, energy usage, electricity tariff or personal circumstances and is not financial, tax or electrical advice.
We take care to keep the website accurate and up to date, but product specifications, prices, government rebates and incentives change from time to time. Please confirm any information that is important to you with our team before relying on it.
2. Quotes, pricing and orders
- Any prices, estimates or online quotes are indicative only and are not an offer capable of acceptance. A binding agreement is only formed when you accept a written quote or contract from us.
- Final pricing may depend on a site inspection, roof type, switchboard condition, distributor approval and other site-specific factors. We will tell you about any change before work proceeds.
- Unless stated otherwise, prices are in Australian dollars and include GST.
- The terms of your written quote or installation contract apply to the supply and installation of any products or services. If there is any inconsistency, your written contract prevails over these Terms.
3. Government rebates, incentives and STCs
Rebates, incentives and small-scale technology certificates (STCs) – including those under the Small-scale Renewable Energy Scheme, the Cheaper Home Batteries Program and Solar Victoria programs – are set by governments and scheme administrators. Eligibility rules, amounts and availability can change or close at short notice, and some STC values reduce over time. Any rebate or STC amount shown on our website or in a quote is an estimate based on the rules at that time and is subject to your eligibility and approval by the relevant scheme.
4. Your rights under the Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be excluded.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Manufacturer warranties on panels, inverters, batteries and other products, and any workmanship warranty we provide, are in addition to your rights under the Australian Consumer Law. Warranty terms are set out in your quote, contract and product documentation.
5. Acceptable use
You must not use the website in any way that is unlawful, that infringes anyone’s rights, or that could damage, disable or impair the website – including by introducing viruses, attempting unauthorised access, scraping content, or submitting false, misleading or spam enquiries.
6. Intellectual property
Unless stated otherwise, the content on this website (including text, graphics, logos, photos and design) is owned by or licensed to Countryman Solar and is protected by Australian and international copyright and trade mark laws. You may view and print pages for your personal, non-commercial use. You must not otherwise copy, reproduce, publish or adapt any content without our prior written consent. Product names and brand logos belong to their respective owners.
7. Third-party links and services
The website may contain links to, or embedded content from, third-party websites and services (for example manufacturers, government programs and Google Maps). We do not control and are not responsible for their content, availability or privacy practices.
8. Limitation of liability
To the maximum extent permitted by law (and subject to section 4), Countryman Solar is not liable for any loss or damage arising from your use of, or reliance on, the website or its content, or from the website being unavailable, interrupted or containing errors or viruses. Where our liability for a failure to comply with a consumer guarantee can lawfully be limited, it is limited (at our option) to resupplying the services or paying the cost of having them supplied again, or to repairing or replacing the goods or paying the cost of doing so.
9. Privacy
Any personal information you give us through the website is handled in accordance with our Privacy Policy.
